Commercial litigation is a general term that applies to any type of litigation or controversy related to business issues. insurance coverage and bad faith litigation
Every contract contains what is called an "implied covenant of good faith and fair dealing," where neither party will do anything to injure the right of the other to receive the benefits of the agreement. This means that when you file a legitimate insurance claim your insurance company cannot unreasonably, or without proper cause, withhold the benefits due you under your insurance policy. If your insurance company denies or delays paying a claim unreasonably or without proper cause, then it has acted in "bad faith." Bad faith applies to just about every type of insurance policy, including commercial general liability insurance, director’s and officer’s liability insurance, automobile insurance, commercial insurance, health insurance, life insurance and property insurance.
If an insurance company breaks this law, the policyholder can collect more than what is contractually owed under the policy. In addition to the insurance policy benefits, the policyholder can collect all damages caused by the unreasonable denial of benefits or unreasonable delay in processing the claim, including such damages as emotional distress, economic losses and attorney fees.
If the insurance company acts in an outrageous or malicious manner, then punitive damages can also be awarded by a jury.

The Firm’s Environmental Litigation practice includes remediation and cost recovery litigation under the "Superfund" law and its state equivalents; regulatory compliance and criminal matters under local, state and federal environmental regulations and laws; and environmental insurance coverage litigation.
