Insurance Bad Faith
$11,061,188 jury verdict, including punitive damages, in bad faith case against an insurer that refused to defend its insured in a lawsuit brought by a third party under the insured’s general liability insurance.
$3,700,000 settlement in bad faith case against an insurer that refused to defend corporate officers and company in a lawsuit brought by another corporate officer under the company’s directors and officers liability insurance.
Commercial Litigation
Following a three week jury trial, obtained a defense verdict, awarding plaintiff nothing, on behalf of our client, a software development company, where the plaintiff was seeking damages from our client in the amount of $8.9 million.
Obtained a $600,000 settlement for our client, a software company, although our client was sued first by the plaintiff seeking damages in excess of $1,200,000 in connection with our client’s alleged breach of a contract between the parties.
Real Estate Litigation
Obtained a settlement in excess of $900,000, including attorney’s fees, for our clients, a group of commercial tenants, against their landlord stemming from the landlord’s failure to maintain our clients’ premises under a commercial lease.
Obtained a settlement on behalf of our client, a commercial tenant, for approximately ten percent of the mid-seven figure amount the landlord was seeking in its lawsuit against our client.
General Civil Litigation
Negotiated the dismissal of a lawsuit against our client, a fire suppression system contractor, alleging our client’s work was performed improperly, before our client was required to respond to the allegations.
Obtained a dismissal of all claims against our clients, a husband and wife, including allegations of fraud seeking punitive damages, stemming from an alleged complex conspiracy to defraud a well known auction house.
Environmental Litigation
Obtained a $3 million settlement payment to our clients, defendants in a federal CERCLA cost recovery lawsuit, where they were being sued for $26 million.
Negotiated dismissal of all claims against our client, a defendant in a federal CERCLA cost recovery lawsuit, arising out of our client’s ownership and operation of a hazardous waste storage and transportation facility.
Represented client in connection with U.S. EPA’s CERCLA Section 104(e) Request for Information and negotiated more restrictive disclosure of documents than originally sought by EPA.
Securities Litigation
Represented The People of the State of California and obtained a multi-million dollar recovery from defendant bank that allegedly defrauded public pension fund out of millions of dollars through its alleged unfair business practices.
